When you send polycom a broken unit to be replaced in my example a VS4000, shouldnt one or more option keys for H.264 or encryption be entered and enabled even if the original unit didnt have any of these options and was out of warranty?

I though i read somewhere that they will enabled the options on the replacement unit.

I think I remember reading somewhere that you have to have purchased the unit after Oct 2003 or have it under service. I dont think service means warranty, but a maintenance plan.

I honestly do not undestand why they charge for H.264.

On a similar note, have you done a side by side with another VS4000/FX to compare H.264 and H.263? :-)

I’ve had a couple of replacement units come in with both options enabled. My assumption would be that they are sending replacement units with keys just in case, but I haven’t seen anything official regarding this.

Unless something has changed, the H.264 upgrade is free if you are under a service contract (and I'm assuming you are because it was replaced.) Your reseller should be able to supply you with a key if necessary. This is what we have done for our customers who are under a service contract.

The units I was referring to above are silver units that have been replaced under warranty. Now having said that, we just purchased a service contract that covers all of the VS4000 units with the primary goal of getting the keys for the rest of the units. The way the pricing is structured it was cheaper to buy a year of service than to buy the two key codes.
